Terms of Service

These Terms govern access to and use of SwitchPilot, including its dashboard, API, documentation and SDKs. SwitchPilot is designed primarily for professional users such as independent developers, SaaS founders, startups, product and engineering teams, and agencies.

By creating an account or using the service, you agree to these Terms. If you act for an organisation, you confirm that you have authority to bind it. You must have legal capacity to enter into these Terms and be at least the minimum age required by the law applicable to you.

Paid subscriptions are also governed by the Sales Terms. Personal data is handled as described in the Privacy Policy.

• Provide accurate, current information and keep it updated.
• Protect your password, session and any credentials associated with the account.
• You are responsible for activity performed through your account unless caused by a failure attributable to SwitchPilot.
• Notify dev.triven.kadiata@gmail.com promptly if you suspect unauthorised access or credential compromise.
• Keep server API keys private. Do not publish them in client-side code, public repositories, logs or support messages.

You may use SwitchPilot in the ordinary course of your professional activity to:

• create projects and manage feature flags;
• integrate the supported SDKs and API into your applications;
• control feature behaviour and rollout decisions; and
• use Development and Production environments to the extent included in your plan.

Your use must comply with applicable law, these Terms and the documented technical limits.

You must not:

• access accounts, systems or data without authorisation;
• circumvent plan limits, access controls, rate limits or security measures;
• reverse engineer the service beyond what applicable law expressly permits;
• scrape or extract data at scale outside supported interfaces;
• perform attacks, vulnerability scans, penetration tests or load tests without prior written approval;
• use the service to distribute malware or facilitate unlawful activity;
• publish or share a server API key or another user's credentials;
• infringe third-party rights or process data without an appropriate legal basis; or
• resell, sublicense or provide the service as a standalone product without written agreement.

You remain responsible for your deployments, flag rules, environments, application architecture and decisions to enable or disable features. An incorrectly configured or used flag may interrupt a service, expose an unfinished feature or change application behaviour.

Test changes before production, restrict access to sensitive flags, keep appropriate fallbacks and maintain your own recovery procedures. SwitchPilot does not guarantee that a toggle pattern is suitable for every critical architecture. The service is not presented by default as suitable for medical, nuclear, military, life-safety or similar high-risk systems.

SwitchPilot uses reasonable efforts to keep the service available and secure. Maintenance, updates, incidents, third-party failures and events outside reasonable control may cause interruptions. Absolute or uninterrupted availability is not guaranteed.

Features may be corrected, updated, replaced or discontinued as the product evolves. When a material change is reasonably likely to affect ongoing use, SwitchPilot will seek to provide appropriate notice where practicable.

SwitchPilot and its licensors retain rights in the service, code, brand, interface and documentation. You retain rights in the projects, flag names, configurations and other content you submit.

You grant SwitchPilot a limited, non-exclusive licence to host, copy, transmit and otherwise process that content only as necessary to provide, secure and support the service. You are responsible for having the rights needed to provide it.

Feedback may be used to improve SwitchPilot without payment or transfer of your confidential data. Feedback does not grant permission to disclose your confidential information or reuse your projects as public examples.

Each party should protect non-public information received from the other with reasonable care and use it only for the relationship. This does not cover information that is public without breach, already lawfully known, independently developed or lawfully received from another source. A legally required disclosure may be made, with notice where the law permits.

Access may be limited or suspended where reasonably necessary to address abuse, a security risk, fraud, a serious breach, legal requirements or non-payment. Where appropriate, SwitchPilot will try to give notice and an opportunity to remedy the issue.

You may close your account in Dashboard Settings. Account deletion first cancels any linked Paddle subscription immediately, then removes the account and associated projects, flags, environments and stored API-key hashes from the live application database. If cancellation cannot be confirmed, the account is not deleted.

After termination, access ends and data may be deleted or anonymised under the Privacy Policy. Information may be retained where required by law or needed to resolve disputes and protect the service.

To the extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable, including loss of profit, revenue, goodwill or business opportunity. Users remain responsible for maintaining appropriate backups, fallback behaviour and release controls.

Subject to mandatory law, SwitchPilot's aggregate liability relating to the service is limited to the fees paid for SwitchPilot during the 12 months immediately before the event giving rise to the claim.

Nothing excludes or limits liability for fraud, wilful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence, or any obligation that applicable law does not allow to be excluded or limited. Mandatory user protections remain unaffected.

These Terms are governed by French law, subject to any mandatory protections applicable to the user. The parties should first try to resolve a dispute in good faith. Nothing in these Terms removes a right to bring a claim before a competent court under mandatory law.

These Terms may be updated to reflect product, legal or security changes. Material changes will be communicated by a reasonable method before they take effect where required. Continued use after the effective date means acceptance of the revised Terms, without limiting mandatory rights.
